reach sufficient maturation to function in compliance with the performance standards <br />adopted by the city. <br />F. The city shall stop work on any existing permits and halt the issuance of any or all future <br />permits or approvals for any activity which violates the provisions of this chapter, until the <br />property is fully restored in compliance with this chapter and all penalties are paid. <br />G. Notwithstanding the other provisions provided in this chapter, anything done contrary to <br />the provisions of this chapter or the failure to comply with the provisions of this chapter is <br />declared to be a public nuisance. <br />H. The city is authorized to apply to any court of competent jurisdiction and any such court, <br />upon hearing and for cause shown, may grant a preliminary, temporary or permanent <br />injunction restraining any person, firm, and/or corporation from violating any of the <br />provisions of this chapter and compelling compliance with the provisions thereof. The <br />violator shall comply with the injunction and pay all costs incurred by the city in seeking <br />the injunction. <br />(This section shall be codified as EMC 19.37.260.) <br />Section 27: Definition. Section 3 of Ordinance No. 1847-92, as amended, (EMC 19.4.020), <br />definition of "Adjacent," which currently reads as follows: <br />"Adjacent" means any human -induced action which impacts the existing condition of an <br />environmentally sensitive area. Alterations include but are not limited to grading; filling; <br />dredging; draining; channelizing; cutting, pruning, limbing or topping, clearing, <br />relocating or removing vegetation; applying herbicides or pesticides or any hazardous or <br />toxic substance; discharging pollutants; grazing domestic animals; paving, construction, <br />application of gravel; modifying for surface water management purposes; or any other <br />human activity that impacts the existing vegetation, hydrology, wildlife or wildlife <br />habitat. Alteration does not include walking, passive recreation, fishing or other similar <br />activities. <br />is hereby deleted. <br />(This section shall be codified as EMC 19.37.270.) <br />Section 28: Definition.
