• <br /> Nod ' <br /> EVE/FETT <br /> ORDINANCE NO. /969- 93 <br /> AN ORDINANCE amending the City' s Land Use Hearing <br /> Examinerrs Ordinance, Ordinance No. 692-80 as <br /> amended by Ordinance Nos. 819-91, 1121-85, 1323-87 <br /> and 1532-88 , Chapter 2 . 23 EMC. <br /> THE CITY OF EVERETT DOES ORDAIN: <br /> SECTION 1: Section 12 of Ordinance No. 692-80 (EMC 2 . 23 . 120) <br /> as amended by Section 1 of Ordinance No. 1323-87 reads as <br /> follows: <br /> Section 12 : DUTIES OF THE EXAMINER: <br /> The duties of the Examiner shall be as follows: <br /> A. Development Actions. <br /> The Examiner shall receive and examine available <br /> information including environmental checklists and <br /> impact statements, conduct public hearings, prepare a <br /> record thereof, enter findings of fact and conclusions <br /> based upon those facts, and enter decisions as provided <br /> herein. <br /> 1. Decisions. The decisions of the Examiner shall <br /> represent the final action on the application, <br /> unless appealed, as hereinbelow specified, for the <br /> following types of development action: <br /> a. Appeals of decisions made by the Responsible <br /> Official under the provisions of the City' s <br /> Environmental Policy ordinance, unless <br /> otherwise provided in said ordinance; <br /> b. Waivers, exceptions and appeals from <br /> administrative determinations of the City' s <br /> Street and Sidewalk Codes unless otherwise <br /> provided in said codes; <br /> c. Appeals from administrative determinations of <br /> the City' s land use regulation codes; all <br /> appeals from land use regulation codes shall <br /> be filed with the City Clerk no later than <br /> ten (10) working days from the date of the <br /> written decision; <br />
