• <br /> • <br /> b. Rezones for which there is a concurrent <br /> application for a development action as is <br /> set forth in Section 12 (A) (1) regardless of <br /> the size of the rezone. In this case, the <br /> Examiner ' s decision shall constitute a <br /> recommendation as to the rezone and a <br /> decision as to the concurrent application for <br /> the development action; <br /> c. Where a rezone is combined with a preliminary <br /> subdivision procedure, the Hearing Examiner <br /> shall have jurisdiction over the entire <br /> procedure. The Examiner ' s decision shall <br /> constitute a recommendation as to the rezone <br /> and a decision as to the preliminary <br /> subdivision; <br /> d. Where a Comprehensive Plan amendment is <br /> combined with a rezone, the Planning <br /> Commission shall have jurisdiction over the <br /> entire procedure. The Planning Commission <br /> shall retain jurisdiction over all other <br /> rezones not listed in this section including <br /> all amendments to Title 19 as set forth in <br /> EMC 19 . 68 . 010; <br /> e. Planned residential developments except for <br /> proposed developments exceeding 50 <br /> residential units in size. <br /> 3 . Jurisdiction Retained by Planning Commission. <br /> Under the provision of City Ordinance No. 3-68 and <br /> RCW 35 . 63 , the Planning Commission shall retain <br /> jurisdiction for all applications for development <br /> not assigned to the Hearing Examiner by this <br /> Ordinance. <br /> B. Recommendation or Decision, Conditions. <br /> 1. The Examiner' s recommendation or decision may be <br /> to grant or deny the applications, or the Examiner <br /> may recommend or require of the applicant such <br /> conditions, modifications and restrictions as the <br /> Examiner finds necessary to make the application <br /> compatible with its environment and carry out the <br /> objectives and goals of the Comprehensive Plan, <br /> Shoreline Management Master Program, Housing <br /> Assistance Plan, other applicable plans and <br /> programs adopted by the City Council, the Zoning <br /> Ordinance, the Subdivision Ordinance and other <br /> 3 <br />
