• EL/E/FETT ORDINANCE NO. /961e.- Q3 AN ORDINANCE creating a special improvement project fund entitled "SR 52611-5 High Occupancy Vehicle (HOV) Lane Project, Fund No. 365, to accumulate all design and construction costs for the improvement project, and repealing Ordinance No. 1859-92. WHEREAS, the City Council recognizes that as new development takes place in the Southwest Everett and Paine Field areas consistent with the Southwest Everett Comprehensive Plan, Snohomish County's Paine Field Area Comprehensive Plan, the Paine Field Airport Master Plan, and the City of Mukilteo's Comprehensive Plan, that access improvements must be made to accommodate the increase in the vehicular traffic generated by this development; and WHEREAS, the traffic studies conducted by the Boeing Company show that some form of High Occupancy Vehicle (HOV) facilities are needed on SR 526 to help accommodate increasing traffic volumes; and WHEREAS, the study, design, and construction of HOV improvements on SR 526 are an integral part of the program to mitigate the off-site traffic impacts of the Boeing plant expansion; and WHEREAS, the Boeing Company has pledged funding for the study, design, and construction of HOV improvements on SR 526; and WHEREAS, based on recent studies, Boeing, WSDOT, FHWA, and Everett have collectively agreed upon a right-side HOV lane along eastbound SR 526 and southbound Interstate 5 between Evergreen Way and 128th Street; and WHEREAS, federal and state grants have been obtained to supplement the Boeing mitigation monies and provide the remaining funds needed to design and construct the new HOV lane; and WHEREAS, on February 12, 1992, City Council passed Ordinance No. 1859-92, establishing Fund 365, entitled "Study of SR 526 High Occupancy Vehicle (HOV) Treatment Alternatives," to provide funding for the study of HOV options on State Route 526; 1
