Section 2: That the City of Everett shall not be responsible nor liable for storm drainage runoff resulting from existing drainage patterns as established on City rights-of-way that may currently, or in the future, go over, under or across the above described in Section 1 herein. Section 3: That this ordinance shall not become effective until the owners of the property abutting upon the street herein described have conveyed by Statutory Warranty Deed to the City of Everett the following described right-of-way: BEGINNING AT THE SOUTHWEST CORNER OF THE NORTHEAST QUARTER OF THE NORTHEAST QUARTER OF THE NORTHEAST QUARTER OF SECTION 19, TOWNSHIP 28 NORTH, RANGE 5 EAST, W.M.; THENCE S 89°16'53"E, ALONG THE SOUTH LINE OF SAID NORTHEAST QUARTER OF THE NORTHEAST QUARTER OF THE NORTHEAST QUARTER, A DISTANCE OF 30.02 FEET; THENCE N 05°17'19"w 141.58 FEET; THENCE N 01°14'15"w 192.18 FEET TO THE NORTH LINE OF THE SOUTH HALF OF THE NORTHEAST QUARTER OF THE NORTHEAST QUARTER OF THE NORTHEAST QUARTER OF SAID SECTION; THENCE N 89°11'41"W, ALONG SAID NORTH LINE, 20.01 FEET TO THE NORTHWEST CORNER OF SAID SOUTH HALF; THENCE N 01°14'15"W, ALONG THE EAST LINE OF THE NORTHWEST QUARTER OF THE NORTHEAST QUARTER OF THE NORTHEAST QUARTER OF SAID SECTION 19, A DISTANCE OF 303.08 FEET TO THE SOUTH LINE OF THE NORTH 30 FEET OF SAID SECTION 19; THENCE N 89°06'30"W, PARALLEL WITH THE NORTH LINE OF SAID SECTION 19, A DISTANCE OF 25.02 FEET; THENCE S 01°14'15"E 495.23 FEET; THENCE S 00°47144"W 140.94 FEET TO THE SOUTH LINE OF THE NORTHWEST QUARTER OF THE NORTHEAST QUARTER OF THE NORTHEAST QUARTER OF SAID SECTION 19; THENCE S 89°16'53"E, ALONG SAID SOUTH LINE OF SAID NORTHWEST QUARTER, A DISTANCE OF 30.02 FEET TO THE POINT OF BEGINNING. ALL SITUATE IN THE CITY OF EVERETT, COUNTY OF SNOHOMISH, STATE OF WASHINGTON. CONTAINING 23,626 SQUARE FEET OR 0.542 ACRES, MORE OR LESS. The abutting property owners shall have ninety (90) days following passage of this ordinance to exercise this vacation. Unless otherwise amended by City Council, this ordinance shall be null and void if the abutting property owner(s) fail to exercise this vacation within ninety (90) days following passage of this ordinance.
