i <br /> taxes shall be levied upon, and collectible from, the person <br /> engaging in the business activities herein designated and <br /> that such taxes shall constitute a part of the operating <br /> overhead of such persons. <br /> Section 37 : Effective Date - Savings Clause. <br /> The following ordinances regarding the City's business and <br /> occupation tax existed prior to the adoption of this <br /> ordinance: 2711, 3272 , 3292 , 3435, 3705, 3726, 4070, 194-72 , <br /> 567-78 , 900-82 , 1060-84 , 1387-87 , 1417-87 , 1431-87, 1795-91, <br /> and 1913-92 . <br /> The above-referenced ordinances are hereby superseded, <br /> except 2711 and 3272, by the adoption of this ordinance, <br /> provided, however, the above referenced ordinances are not <br /> superseded as to any tax incurred or provisions relating <br /> thereto, offense committed, any penalty, forfeiture or <br /> punishment incurred, or any City or taxpayer claim arising <br /> under the former ordinances. <br /> Nothing contained in this section shall be construed as <br /> abating any action now pending under or by virtue of any <br /> ordinance of the City tax incurred or herein superseded; or <br /> as discontinuing, abating, modifying or altering any penalty <br /> accrued or to accrue, or as affecting the liability of any <br /> person, firm or corporation, or as waiving any right of the <br /> City under any ordinance or provision thereof in force at <br /> the time of passage of this ordinance. <br /> Section 36: Severability. <br /> If any provision or section of this chapter shall be held <br /> void or unconstitutional, all other parts, provisions and <br /> sections of this chapter not expressly so held to be void or <br /> unconstitutional shall continue in full force and effect. <br /> PT ICH, Mayor <br /> AT EST: <br /> j <br /> C TY CLERK <br /> Passed: 10/13/93 <br /> Valid: 10/18/93 <br /> Published: 10/25/93 <br /> Effective: 11/03/93 <br /> 34 <br />
