EV/ERETT <br /> ORDINANCE NO. 1957-93 <br /> An Ordinance Amending the Zoning Map of the City of Everett as <br /> provided by Ordinance No. 1671-89, as amended, Rezoning Certain <br /> Property Located on the west side of the 1800 Block of McDougall <br /> Avenue from R-2 (Single Family Medium Density) to B-2 (Community <br /> Business) , and confirming compliance with the terms of Resolution No. <br /> 3396. <br /> WHEREAS, Broadway Hardware applied for a rezone of property located on <br /> the west side of the 1800 block of McDougall Avenue, the legal <br /> description of which is: <br /> Lots 19 , 20 , 21 , and 22 of Block 363 of Division N of the Plat of <br /> Everett, as recorded in Volume 5, Page 7 of Plats, records of <br /> Snohomish County, Washington, <br /> for the purpose of constructing a parking lot for the retail business <br /> located adjacent to the west; and <br /> WHEREAS, Broadway Hardware agreed to limit use of the subject lots to <br /> off-street parking for the use of the retail business located to the <br /> west of the above described lots, and has agreed to certain specified <br /> standards for the development of said parking lot; and <br /> WHEREAS, the City Council did pass Resolution No. 3396 on November 14 , <br /> 1990 , which declared the City's Intent to Rezone the subject property <br /> upon completion of the construction of the parking lot in accordance <br /> with the terms and conditions specified in said Resolution of Intent; <br /> and <br /> WHEREAS, the City Council finds that: <br /> 1 . By establishing standards for the use and development of the <br /> subject properties, the Resoultion of Intent to Rezone is <br /> consistent with the revised designation of the Everett General <br /> Plan. <br /> 2 . By limiting the use of the subject properties to off-street <br /> parking, the existing commercial businesses fronting on Broadway <br /> will be enabled to bring the currently deficient off-street parking <br /> supply up to current code requirements which, as conditioned, will <br /> promote the public health, safety and welfare; and will promote the <br /> best long term interests of the Everett community. <br /> 3 . The high standards for landscaping, the limitations on access, <br /> the limitations on signs, and the other normal requirements of the <br /> zoning code which will be implemented through the Resolution of <br /> Intent to Rezone agreed to by the applicant and the City are <br /> sufficient to mitigate adverse impacts upon existing or anticipated <br /> land uses in the immediate vicinity of the subject property. <br />
