ELSRETT ORDINANCE NO. 1955-93 AN ORDINANCE amending Ordinance No. 1674-90, the Merrill Creek Rezone. Whereas, the City Council adopted Ordinance No. 1674-90 which rezoned the area generally described as West of Glenwood Avenue, and North of Merrill Creek Parkway within Southwest Everett from R-S and R-1 to R-3 (A) subject to the conditions of a concomitant agreement; and Whereas, the City Council finds that certain conditions of the concomitant agreement including exhibits thereto need to be revised; and Whereas, the concomitant agreement required that the applicant donate 3 . 9 acres of property to the Mukilteo School District. The property donated needs to be removed from the rezone ordinance and revert to its original zoning designation; and Whereas, the City Council finds that the revisions set forth herein are consistent with the comprehensive plan and are in the best interests of the health, safety and welfare of the citizens of Everett; NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: Section 1: Section 1 of Ordinance No. 1674-90 adopted by reference Exhibit "A" , a legal description of the property, which exhibit is attached hereto and incorporated herein by reference. Section 1 of Ordinance No. 1674-90 is hereby amended by the adoption of Exhibit "1" , a revised legal description of the property, which is attached hereto and incorporated herein by reference which exhibit shall supersede and respectively replace in its entirety Exhibit "A" . Section 2 : Ordinance No. 1674-90 is hereby amended by the adoption of Exhibit "E" which is attached hereto and incorporated herein by reference. The Mukilteo School District property legally described in Exhibit "E" is no longer subject to the rezone adopted in Ordinance No. 1674- 90. The property described in Exhibit "E" does hereby revert to its original zoning designation of R-1, Single Family Low Residence Zone.
