NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> SECTION 1: Section 18 of Ordinance No. 1670-89 as amended by <br /> Section 1 of Ordinance No. 1833-91 reads as follows: <br /> The Council finds that this ordinance is necessary for <br /> the immediate preservation of the public peace, health, <br /> safety and the public welfare. This ordinance shall <br /> remain in effect until December 31, 1993 . <br /> SECTION 2 : Ordinance No. 1670-89 is hereby amended by the <br /> addition of the following section: <br /> Notwithstandng the provisions of this ordinance, any <br /> applicant for a development project within the core <br /> area shall be exempt from the traffic mitigation <br /> requirements established in this ordinance except for <br /> Section 14 of Ordinance No. 1670-89 . Provided, <br /> further, the Traffic Engineer may require appropriate <br /> mitigation measures as set forth in The Guide to Land <br /> Use and Public Transportation in Snohomish County <br /> including transportation demand management measures in <br /> order to lessen the traffic impact of the proposed <br /> development. For purposes of this ordinance the core <br /> area is defined as that area bounded by Pacific Avenue <br /> on the south, Broadway on the east, Everett Avenue on <br /> the north and Marine View Drive on the west. SEPA <br /> decisions which have been issued for projects in the <br /> core area but for which building permits have not been <br /> issued as of the date this ordinance revision is passed <br /> are eligible for revision in accordance with the <br /> provisions of this section. <br /> SECTION 3 : SEVERABILITY. <br /> Should any section, subsection, paragraph, sentence, clause or <br /> phrase of this ordinance or its application to any person or <br /> situation be declared unconstitutional or invalid for any reason, <br /> such decision shall not affect the validity of the remaining <br /> portions of this ordinance or its application to any other person <br /> or situation. The City Council of the City of Everett hereby <br /> declares that it would have adopted this ordinance and each <br /> section, subsection, sentence, clause, phrase or portion thereof <br /> 2 <br />
