Based upon the November 3, 2010 public hearing, the attached Ordinance provides the following conditions of vacation: 1) a 20 foot wide easement for water views with restrictions; and 2) compensation in the amount of$70,000 be provided to the City for the right of way area being vacated. Attached is a memo providing an explanation for, and proposed language of, a possible amendment to the Ordinance restricting the future development of the parcels in a manner that provides compatibility with the character of the surrounding properties. RECOMMENDATION (Exact action requested of Council): Adopt the attached Ordinance vacating that portion of 1 lth Street lying west of Grand Ave subject to the conditions as set forth in the Ordinance. 103
