(T)) Customer Charges for Extensions of Service <br /> No customer shall be refused service arbitrarily. However, for unusual circumstances, such as the <br /> existence of more than one hundred twenty-five (125) feet of distance from distribution cable to <br /> connection of service to customers, or a density of less than twenty-five (25) residences per 5280 <br /> cable-bearing strand feet of trunk or distribution cable, service may be made available on the basis <br /> of a capital contribution in aid of construction,including cost of material, labor and easements. For <br /> the purpose of determining the amount of capital contribution in aid of construction to be borne by <br /> the Grantee and customers in the area in which service may be expanded, the Grantee will <br /> contribute an amount equal to the construction and other costs per mile, multiplied by a fraction <br /> whose numerator equals the actual number of residences per 5280 cable-bearing strand feet of its <br /> trunk or distribution cable and whose denominator equals twenty-five(25). Customers who request <br /> service hereunder will bear the remainder of the construction and other costs on a pro rata basis. <br /> The Grantee may require that the payment of the capital contribution in aid of construction borne by <br /> such potential customers be paid in advance. <br /> 14.2 Connection of Public Facilities <br /> Grantee shall provide, without charge, one outlet of Basic Service and Expanded Basic <br /> Service to all existing City owned (or leased) and occupied buildings, fire stations,police stations, <br /> schools and public libraries in the City if such locations are currently receiving any Cable Service, <br /> or to other such locations if they are within one hundred twenty-five feet (125') of the Cable <br /> System. In addition, Grantee shall provide,at no cost to the City or other entity, one outlet of Basic <br /> and Expanded Basic Service to future owned (or leased) and occupied City buildings, fire stations, <br /> police stations, schools and public libraries upon request if the drop line to such building does not <br /> exceed one hundred twenty-five feet(125'). If,in any instance,the City or other entity agrees to pay <br /> the incremental cost of such drop line in excess of one hundred twenty-five feet (125'), including <br /> the cost of such excess labor and materials, then Grantee shall provide such free Basic and <br /> Expanded Basic Service. Such obligation to provide free Cable Service shall not extend to areas of <br /> City buildings where the Grantee would normally enter into a commercial contract to provide such <br /> Cable Service (e.g., golf courses). Outlets of Basic and Expanded Basic Service provided in <br /> accordance with this subsection may be used to distribute Cable Services throughout such <br /> buildings,provided such distribution can be accomplished without causing Cable System disruption <br /> and general technical standards are maintained. Such outlets may only be used for lawful purposes. <br /> SECTION 15. FRANCHISE VIOLATIONS <br /> 15.1 Procedure for Remedying Non-Material Franchise Violations <br /> (A) If the City believes that Grantee has failed to perform any non-material obligation <br /> under this Franchise or has failed to perform in a timely manner, the City shall notify Grantee in <br /> writing, stating with reasonable specificity the nature of the alleged default.
