2 <br /> Excerpt from Planning Commission minutes of February 1, 2011 <br /> 7:07:46 PM <br /> Item#3: Public Hearing and Recommendation — Requirement for land survey related to <br /> setbacks and heights of buildings. <br /> Allan Giffen stated that the proposal is a new regulation that would require an on-site physical <br /> survey to demonstrate that a proposed building or building addition meets Zoning Code setback <br /> requirements and height requirements. The City's legal department has requested the revision <br /> because there have been a number of situations where buildings have been constructed in the <br /> wrong location and/or at the wrong height. <br /> 7:11:38 PM <br /> Commissioner Hale asked if a citizen wanted to do some repairs or remodel a building and it <br /> was determined that it was not built according to the approved heights or within the setbacks, <br /> could the building be repaired or remodeled in the same footprint and height. Mr. Giffen <br /> responded as long as the building was certified as a nonconforming building it could be repaired <br /> or even expanded. Mr. Koenig stated that the language is intended for new construction or <br /> additions to the dwelling, and not for reroofs, siding, or electrical permits. <br /> 7:13:23 PM <br /> Chairperson Sosin asked if previously constructed buildings would be "grandfathered." Mr. <br /> Giffen responded yes, and so much of north Everett was built prior to 1956 that many buildings <br /> predate the Code and do not comply with current standards. Those structures would be <br /> recognized as nonconforming buildings. <br /> 7:15:08 PM <br /> Commissioner Sand would like the verbiage changed to a "licensed professional surveyor." Mr. <br /> Giffen stated that could be added. Commissioner Olivers asked if the language came from <br /> RCW Chapter 58.09. Mr. Giffen responded yes. <br /> 7:16:08 PM <br /> Chairperson Sosin asked about a menu of alternative methods to prove compliance and asked <br /> if staff was concerned about administering. Mr. Giffen responded that compliance would be <br /> reviewed on a case by case basis and staff would default to the survey requirement where <br /> required by code. Chairperson Sosin asked about the methods to determine compliance with <br /> the height requirement given the topography of some of the lots. Mr. Giffen responded that <br /> heights are measured from a base elevation. Chairperson Sosin asked if staff were comfortable <br /> with the methodology. Mr. Giffen responded yes. <br /> Citizen Comments <br /> 7:18:17 PM <br /> Aileen Langhans, 2630 Grand Avenue, stated she did want to alert Commissioners that she was <br /> having problems getting a deck repaired because she is not able to prove that the deck had <br /> existed prior to 1956. She stated that if the City was going to require a builder to do a survey of <br /> the property, City planners should be able to read surveys. She stated that her neighbor did a <br /> survey and submitted drawings to the City; however, the staff person was not able to see that <br /> her garage had been included in the area of their.proposal. <br /> 5 <br />
