FEMA lost <br /> a lawsuit alleging that its administration of the National Flood Insurance Program (NFIP) did not adequately <br /> address the impacts of floodplain development on endangered species. The National Marine Fisheries <br /> Service has issued a Biological Opinion describing measures that FEMA can use to comply with the <br /> Endangered Species Act. FEMA has mandated that local jurisdictions participating in the NFIP must select <br /> one of 3 methods of regulating floodplain development in order to be in compliance with the Biological <br /> Opinion. The consequence of not complying is that property owners in Everett would not be able to obtain <br /> flood insurance. <br /> Staff will make a presentation to describe how the City proposes to use its existing floodplain, shoreline, and <br /> critical area regulations to comply with the Biological Opinion. <br /> RECOMMENDATION (Exact action requested of Council): <br /> 5 <br />
