. . rA*/ fr ---A• EERETT ORDINANCE NO. 1888-92 AN ORDINANCE creating an operations and maintenance fund entitled "Community Theater" Fund- No. 112 and authorizing the operations and maintenance of the performing arts facility and amending the 1992 budget to provide for operations and maintenance of the performing arts facility. WHEREAS, the City entered into a lease contract on November 15, 1991 for the acquisition of a new performing arts facility, and WHEREAS, the City Council has approved, on July 22, 1992, the Community Theater Maintenance and Budget Plan. NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: Section 1: An operations and maintenance fund is hereby established as Fund No. 112, entitled "Community Theater" to accomplish the actions authorized in the subsequent sections of the ordinance. Section 2: Authorization is hereby given to proceed with the steps necessary to operate and maintain the Community Theater as outlined in the Community Theater Maintenance and Budget Plan approved by City Council on July 22, 1992. Section 3: The total estimated costs in 1992 of the contract with an executive director, including overhead for operations and maintenance is $40,000. Section 4: A. The sum of$40,000 is hereby appropriated to Fund 112 "Community Theater". B. Source of funds: General Fund Section 5: Severability. If any provisions of this ordinance shall be declared unconstitutional or invalid by any court of competent jurisdiction, it shall be conclusively presumed that this ordinance would have been enacted without the provision so held unconstitutional or invalid and the remainder of the ordinance shall not he effected as a result of said part being held unconstitutional or invalid.
