Authority to Abate. <br /> a) Any violation of the Code is hereby declared to be <br /> a nuisance. <br /> b) Where a nuisance exists, the City Attorney on <br /> behalf of the City is authorized to institute <br /> injunction, mandamus, or other appropriate action <br /> or proceeding to prevent the violation of this <br /> Code. <br /> c) Not withstanding paragraph (b) , the City Attorney <br /> is authorized to apply to any court of competent <br /> jurisdiction and such court, upon hearing and for <br /> cause shown, may grant a temporary or permanent <br /> injunction restraining any person, firm and/or <br /> corporation from violating any provision of this <br /> Code and compelling compliance herewith. The cost <br /> of such action shall be taxed against the <br /> violator. <br /> d) A conviction of any person, firm or corporation <br /> for violating this Code shall not impede the <br /> authority granted in this section to the City <br /> Attorney or City. <br /> SECTION 4 : The City of Everett hereby declares that should any <br /> section, paragraph, sentence or word of this ordinance or of the <br /> Uniform Mechanical Code hereby adopted be declared for any reason <br /> to be invalid, it is the intent of the City of Everett that it <br /> would have passed all portions of this ordinance and the Code <br /> independent of the elimination wherefrom of any such portion as <br /> may be declared invalid. <br /> SECTION 5: This Ordinance shall not be construed nor held to <br /> repeal Ordinance No. 1611-89 as to any offense committed against <br /> such former ordinance or as to any act done, any penalty, <br /> forfeiture or punishment so incurred or any right accrued or <br /> claim arising under the former ordinance, or in any way whatever <br /> to affect any such offense or act so committed or so done, or any <br /> penalty, forfeiture or punishment so incurred or any right <br /> accrued or claim arising before this ordinance takes effect. <br /> Nothing contained in this section shall be construed as abating <br /> any action now pending under or by virtue of Ordinance No. 1611- <br /> 5 <br />
