D. The State Energy Code and the State Ventilation and Indoor <br /> Air Quality Code are amended by the addition of the following: <br /> Board of Appeals <br /> In order to hear and decide appeals of orders, <br /> decisions or determinations made by the Building <br /> Official relative to the application and interpretation <br /> of this code, there shall be and is hereby created a <br /> Board of Review pursuant to Ordinance No. 351-75 as <br /> amended or hereafter superseded. Appeals from written <br /> orders of the Building Official must be filed within <br /> thirty (30) calendar days from the date of receipt of <br /> the written order by the aggrieved party. The <br /> aggrieved party shall cause to be made at his own <br /> expense any tests or research required to substantiate <br /> his claim <br /> E. The State Ventilation and Indoor Air Quality Code is amended <br /> by the addition of the following: <br /> Radon detectors are to be distributed to all newly <br /> constructed ground floor dwelling units. The cost <br /> which is not to exceed the cost of the detector plus a <br /> reasonable cost for overhead is to be established by <br /> the Building Official and paid by the applicant at the <br /> time of permit issuance. <br /> SECTION 3 : The City of Everett hereby declares that should <br /> any section, paragraph, sentence or word of this ordinance, the <br /> State Energy Code or the State Ventilation and Indoor Air Quality <br /> Code hereby adopted be declared for any reason to be invalid, it <br /> is the intent of the City of Everett that it would have passed <br /> all portions of this ordinance and Code independent of the <br /> elimination herefrom of any such portion as may be declared <br /> invalid. <br /> SECTION 4 : This Ordinance shall not be construed nor held to <br /> repeal Ordinance No. 1614-89 as to any offense committed against <br /> such former ordinance or as to any act done, any penalty, <br /> forfeiture or punishment so incurred, or any right accrued or <br /> claim arising under the former ordinance, or in any way whatever <br /> to affect any such offense or act so committed or so done, or any <br /> penalty, forfeiture or punishment so incurred or any right <br /> accrued or claim arising before this ordinance takes effect. <br /> Nothing contained in this section shall be construed as abating <br /> any action now pending under or by virtue of Ordinance No. 1614- <br /> 89 ; or as discontinuing, abating, modifying or altering any <br /> penalty accrued or to accrue, or as affecting the liability of <br /> 3 <br />
