ORDINANCE NO. 1876-92 E�/E/IETT <br /> AN ORDINANCE related to riding bicycles on sidewalks, <br /> adding a new section to Ordinance No. 459-77 (EMC <br /> Chapter 46. 04 —Model Traffic Ordinance) . <br /> WHEREAS, the Everett Police Department has developed in the last <br /> few years a bicycle unit which has proven to be most effective in <br /> the downtown business district; and <br /> WHEREAS, it is necessary for the bicycle unit to ride their <br /> bicycles on the downtown sidewalks; and <br /> WHEREAS, the law which prohibits riding bicycles on the sidewalks <br /> of business districts currently does not provide a specific <br /> exemption for police bicycles: <br /> NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> Section 1: A new section is hereby added to Ordinance No. 459-77 <br /> (EMC Chapter 46. 04 - Model Traffic Ordinance) , to read as <br /> follows: <br /> Bicycles on Sidewalks - Exemption for Police <br /> The proscriptions of RCW 46. 90. 555 (1) , relating to <br /> riding a bicycle upon a sidewalk in a business <br /> district, shall not apply to police officers while in <br /> the performance of their official duties. <br /> Section 2 : SEVERABILITY. <br /> Should any section, subsection, paragraph, sentence, clause or <br /> phrase of this Ordinance or its application to any person or <br /> situation be declared unconstitutional or invalid for any reason, <br /> such decision shall not affect the validity of the remaining <br /> portions of this Ordinance or its application to any other person <br /> or situation.
