ORDINANCE NO. 1876-92 E�/E/IETT AN ORDINANCE related to riding bicycles on sidewalks, adding a new section to Ordinance No. 459-77 (EMC Chapter 46. 04 —Model Traffic Ordinance) . WHEREAS, the Everett Police Department has developed in the last few years a bicycle unit which has proven to be most effective in the downtown business district; and WHEREAS, it is necessary for the bicycle unit to ride their bicycles on the downtown sidewalks; and WHEREAS, the law which prohibits riding bicycles on the sidewalks of business districts currently does not provide a specific exemption for police bicycles: NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: Section 1: A new section is hereby added to Ordinance No. 459-77 (EMC Chapter 46. 04 - Model Traffic Ordinance) , to read as follows: Bicycles on Sidewalks - Exemption for Police The proscriptions of RCW 46. 90. 555 (1) , relating to riding a bicycle upon a sidewalk in a business district, shall not apply to police officers while in the performance of their official duties. Section 2 : SEVERABILITY. Should any section, subsection, paragraph, sentence, clause or phrase of this Ordinance or its application to any person or situation be declared unconstitutional or invalid for any reason, such decision shall not affect the validity of the remaining portions of this Ordinance or its application to any other person or situation. The City Council of the City of Everett hereby declares that it would have adopted this Ordinance and each section, subsection, sentence, clause, phrase or portion thereof irrespective of the fact that any one or more sections, subsections, sentences clauses, phrases or portions be declared invalid or unconstitutional.
