• <br /> All that portion of Lot 25, Block 1, Plat of Fairmont, according to the <br /> plat thereof, recorded in Volume 10 of Plats, Page 91, records of <br /> Snohomish County, Washington, described as follows: <br /> BEGINNING at the Southeast corner of said Lot 25; THENCE, Northeasterly <br /> along the easterly line of said lot to the Northeast corner thereof; <br /> THENCE, West along the North line of said lot to the Northwest corner <br /> thereof; THENCE, Southwesterly along the Westerly line of said Lot 25 <br /> to intersect a line which bears North 22 40' 00" East from a point on <br /> the South line of said lot, said point being 100 feet East of the <br /> Southwest corner as measured along said South line; THENCE, South 22 <br /> 44' 00" West along said line to intersect the South line of said Lot <br /> 25; THENCE, East along said South line to the Southeast corner of said <br /> Lot 25, and the POINT OF BEGINNING. <br /> TGW AOJ R/W. <br /> Section 2: <br /> That upon annexation of the property described in Section 1, said property <br /> shall become a part of the City of Everett, and shall be subject to all of its <br /> laws and ordinances then and thereafter in force. Upon annexation of the <br /> above-described property, all of said property shall be assessed and taxed at <br /> the same rate on the same basis as other property located within the City is <br /> assessed and taxed, to pay for any then outstanding indebtedness of the City <br /> contracted prior to or existing at the date of this annexation. In addition, <br /> the annexed area will remain responsible unto any other lawfully formed <br /> municipal corporation to which the property is obligated at the time of <br /> annexation subject to a specific lien. Further, the City may incur additional <br /> operating expenses in supplying water or sewage unto persons who are located <br /> within the annexed area. Accordingly, utility rates for the area for which <br /> annexation is petitioned may vary from those rates of other areas within the <br /> City. <br /> Section 3: Severability. <br /> Should any section, subsection, paragraph, sentence, clause or phrase of this <br /> ordinance or its application to any person or situation be declared <br /> unconstitutional or invalid for any reason, such decision shall not affect the <br /> validity of the remaining portions of this ordinance or its application to any <br /> other person or situation. The City Council of the City of Everett hereby <br /> declares that it would have adopted this ordinance and each section, <br /> subsection, sentence, clause, phrase or portion thereof irrespective of the <br /> fact that any one or more sections, subsections, sentences, clauses, phrases <br /> or portions be declared invalid or unconstitutional. <br />
