Apo. <br /> . . <br /> . . <br /> . . <br /> P <br /> EVERETT <br /> ORDINANCE NO. 1874-92 <br /> AN ORDINANCE correcting a rezone for certain property located at the southeast <br /> corner of Everett Mall Way and 4th Avenue S.E. by amending <br /> Section 3 of Ordinance No. 1010-84 <br /> WHEREAS, on January 24, 1984, the Planning Commission held a public <br /> hearing regarding rezoning of the hereinafter described property from R-S, Single <br /> Family Suburban Residential to C-1 , General Commercial with contract; and <br /> WHEREAS, on February 29, 1984, the City of Everett City Council held a <br /> public hearing concerning the rezone of the hereinafter described property from R-S, <br /> Single Family Suburban Residential to C-1 , General Commercial subject to a <br /> Concomitant Agreement regulating development of the site; and <br /> WHEREAS, City Council approved Ordinance No. 1010-84 rezoning the <br /> property; and <br /> WHEREAS, a portion of the property included in the legal description for the <br /> Rezone Ordinance was zoned C-1 , General Commercial; and <br /> WHEREAS, the C-1 zoned portion of the property was included in the site <br /> plan for the Concomitant Agreement to the Rezone Ordinance, as well as the legal <br /> description of the Rezone Ordinance, but was not properly described as being <br /> rezoned in the text of the Rezone Ordinance or in the attached zoning map; and <br /> WHEREAS, the City Council finds that the best interest of the health, safety, <br /> and welfare of the citizens of Everett will be met by clarifying the map to include the <br /> C-1 zoned portion of the lot in the Rezone and Concomitant Agreement to the <br /> Rezone Ordinance; and <br /> WHEREAS, the City Council finds that Ordinance No. 1010-84 should be <br /> corrected to include the C-1 zoned portion of the property in the rezone to make the <br /> ordinance consistent; <br /> NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> Section 1 : That the City Council does hereby find that it is necessary to adopt <br /> this ordinance to clarify the zoning for the property legally described below and <br /> shown on the map in Exhibit "A", attached hereto and incorporated herein by <br /> reference, and such zoning correction is consistent with the applicable provisions of <br /> the Everett General Plan, bears a substantial relation to the public health, safety and <br /> welfare, and promotes the best long term interests of the Everett community. <br />
