"7"4.r <br /> EVE?ETT <br /> ORDINANCE NO. 1873-92 <br /> AN ORDINANCE amending Section 6 of Ordinance No. 1796-91 <br /> providing for the vacation of a portion of <br /> Wilmington Avenue at Evergreen Way. <br /> NOW THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> Section 6 of Ordinance No. 1796-91 which reads as follows: <br /> Section 6: <br /> That the City of Everett hereby retains an easement for <br /> access and to construct, reconstruct, operate, maintain, <br /> repair and replace all utilities within the vacated area. <br /> The City of Everett further retains the right to grant to <br /> public and private utilities the right to construct, <br /> reconstruct, operate, maintain, repair and replace existing <br /> or proposed utility lines including, but not limited to <br /> telephone, gas and electrical, under, over and across the <br /> property described as follows: <br /> An easement lying within a portion of Block 17, <br /> Central Park, as recorded in Volume 8 of Plats on <br /> page 53 , records of Snohomish County, Washington, <br /> and lying also within a portion of vacated <br /> Wilmington Avenue, as shown on said plat, being <br /> more particularly described as follows: <br /> Said easement being of variable width, lying west <br /> to the east line of Evergreen Way (Highway 99) <br /> from the following described line and 10. 00 feet <br /> east of the following described line: <br /> Commencing at the intersection of the southerly <br /> margin of 47th Street as shown on said plat, and <br /> the easterly margin of Evergreen Way; thence N 67 <br /> degrees 21 minutes 06 seconds E along the <br /> southerly margin of said 47th Street 8 .99 feet to <br /> the True Point of Beginning of said line; thence S <br /> 06 degrees 45 minutes 47 seconds W 154 . 11 feet to <br /> the terminus of said line. <br /> Is hereby amended to read as follows: <br /> That the City of Everett hereby retains an easement for <br /> access and to construct, reconstruct, operate, maintain, <br /> repair and replace all utilities within the following <br /> described easement.
