�p/ l • <br /> ORDINANCE NO. /( 'p- <br /> An Ordinance of the City of Everett Adopting a Revised Section 37 of <br /> the Zoning Code pertaining to Environmentally Sensitive Areas <br /> (ESA's) , Repealing and Replacing the Interim Section 37 of Ordinance <br /> 1671-89; Amending Other Related Sections of the Zoning Code <br /> Ordinance 1671-89; Repealing Sections 23 , 24 , 25, and 26 of <br /> Ordinance 1729-90; Repealing Subsection 44.d of Ordinance 1671-89; <br /> and Repealing Ordinances 1765-91, 1812-91 and 1832-91. <br /> WHEREAS, the City adopted a set of Zoning Code regulations for <br /> protection of ESA's in the Zoning Code which became effective in <br /> January, 1990, on an interim basis until the City's General Plan <br /> Policies for ESA's could be re-evaluated; and <br /> WHEREAS, the State Growth Management Act of 1990 requires the <br /> adoption of regulations protecting "critical areas" (ESA's) by <br /> September 1 , 1991; and <br /> WHEREAS, the City has adopted a comprehensive set of policies upon <br /> which to base its regulations for the protection of "critical <br /> areas" ; and <br /> WHEREAS, the Planning Commission has conducted numerous public <br /> workshops and public hearings on ESA's and has considered <br /> substantial amounts of information and a wide variety of viewpoints, <br /> opinions and perspectives concerning ESA's; and <br /> WHEREAS, the Planning Commission formed a sub-committee to review in <br /> detail the proposed revision to Section 37 of the Zoning Code; and <br /> WHEREAS, the Planning Commission has recommended that the City <br /> Council approve the revision to Section 37 of the Zoning Code; and <br /> WHEREAS, the City Council finds that the proposed revision to <br /> Section 37 of the Zoning Code satisfies the requirements of the <br /> Growth Management Act as it relates to "critical areas, " and <br /> WHEREAS, the proposed revision to Section 37 of the Zoning Code <br /> necessitates the change to other sections of the Zoning Code; and <br /> WHEREAS, the City Council finds that the amendments to the Zoning <br /> Code contained herein are consistent with the Everett General Plan; <br /> bear a substantial relationship to public health, safety and <br /> welfare; and promote the best long term interests of the Everett <br /> Community. <br /> NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> Section 1: User Guide. This Ordinance establishes regulations <br /> pertaining to the development of environmentally sensitive areas. <br /> Many areas of Everett have been or may become listed, identified, <br /> inventoried, classified or rated as environmentally sensitive by the <br /> City or other public agencies.
