�p/ l • ORDINANCE NO. /( 'p- An Ordinance of the City of Everett Adopting a Revised Section 37 of the Zoning Code pertaining to Environmentally Sensitive Areas (ESA's) , Repealing and Replacing the Interim Section 37 of Ordinance 1671-89; Amending Other Related Sections of the Zoning Code Ordinance 1671-89; Repealing Sections 23 , 24 , 25, and 26 of Ordinance 1729-90; Repealing Subsection 44.d of Ordinance 1671-89; and Repealing Ordinances 1765-91, 1812-91 and 1832-91. WHEREAS, the City adopted a set of Zoning Code regulations for protection of ESA's in the Zoning Code which became effective in January, 1990, on an interim basis until the City's General Plan Policies for ESA's could be re-evaluated; and WHEREAS, the State Growth Management Act of 1990 requires the adoption of regulations protecting "critical areas" (ESA's) by September 1 , 1991; and WHEREAS, the City has adopted a comprehensive set of policies upon which to base its regulations for the protection of "critical areas" ; and WHEREAS, the Planning Commission has conducted numerous public workshops and public hearings on ESA's and has considered substantial amounts of information and a wide variety of viewpoints, opinions and perspectives concerning ESA's; and WHEREAS, the Planning Commission formed a sub-committee to review in detail the proposed revision to Section 37 of the Zoning Code; and WHEREAS, the Planning Commission has recommended that the City Council approve the revision to Section 37 of the Zoning Code; and WHEREAS, the City Council finds that the proposed revision to Section 37 of the Zoning Code satisfies the requirements of the Growth Management Act as it relates to "critical areas, " and WHEREAS, the proposed revision to Section 37 of the Zoning Code necessitates the change to other sections of the Zoning Code; and WHEREAS, the City Council finds that the amendments to the Zoning Code contained herein are consistent with the Everett General Plan; bear a substantial relationship to public health, safety and welfare; and promote the best long term interests of the Everett Community. NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: Section 1: User Guide. This Ordinance establishes regulations pertaining to the development of environmentally sensitive areas. Many areas of Everett have been or may become listed, identified, inventoried, classified or rated as environmentally sensitive by the City or other public agencies.
