Al <br /> D. Protective Covenants and Tracts. The City may require that <br /> wetlands and their buffers on development sites be placed within <br /> an environmentally sensitive area protective covenant or tract as <br /> provided in Section 20 of this Ordinance. <br /> Section 12: Lakes, Ponds, Constructed and Created Wetlands. <br /> A. Lakes. Lakes which are subject to the Shoreline Master Program <br /> shall be protected as required by Paragraph B of Section 11 of <br /> this Ordinance. Lakes which are not subject to the Shoreline <br /> Master Program shall be protected according to the applicable <br /> wetland category. <br /> B. Ponds. Ponds are considered wetlands unless they were <br /> intentionally created from non-wetland sites, in which case they <br /> do not constitute wetlands and are not regulated by the <br /> provisions of this Ordinance. Ponds shall be protected according <br /> to the applicable wetland category. <br /> C. Constructed Wetlands. Wetlands that were intentionally <br /> constructed by humans from non-wetland sites shall be considered <br /> as artificial wetlands, and shall not be regulated by the <br /> provisions of this Ordinance. Constructed wetlands can include <br /> ponds, irrigation and drainage ditches, grass-lined swales, <br /> canals, storm water detention and retention facilities, and <br /> artificial landscape features. <br /> D. Created Wetlands. Wetlands created to mitigate alteration, <br /> restoration, creation, or enhancement activities allowed pursuant <br /> to this Ordinance shall be protected according to the applicable <br /> wetland category being replaced. <br /> Section 13: Stream Rating. Rating means the placement of streams <br /> into one of the following categories: <br /> A. Category I. Category I streams are those streams inventoried <br /> as "Shorelines of the State" under the City's Shoreline Master <br /> Program, E.M.C. 20. 12 , pursuant to Section 90 . 58 R.C.W, or those <br /> that are used by salmonids. <br /> B. Category II. Category II streams are those streams that are <br /> smaller than Category I streams that flow year round during years <br /> of normal rainfall. <br /> C. Category III. Category III streams are those streams that <br /> are naturally intermittent or ephemeral during years of normal <br /> rainfall and are not used by salmonids in any portion of the <br /> stream system. <br /> D. Category IV. Category IV streams are naturally occurring, <br /> intermittent swales. <br /> Section 14: Standard Stream Buffer Requirements. <br /> A. Standard Buffer Width. It is the goal of this Ordinance to <br /> preserve streams and their buffers in a natural condition to the <br /> maximum extent possible. Buffers shall be measured from the top <br /> 21 <br />
