"Stream" means a year round or intermittent water course or <br /> route, formed by nature or modified by human activities and <br /> generally consisting of a defined channel with a bed, banks, or <br /> sides for a substantial portion of its length, along which <br /> surface waters naturally and normally flow from higher to lower <br /> lands. Streams include natural swales. Wetlands and entirely <br /> artificial water courses such as irrigation and drainage ditches, <br /> grass-lined swales, canals, and stormwater runoff devices shall <br /> not be considered to be streams. Streams which have been <br /> channelized or culverted shall continue to be considered streams <br /> for the purpose of this Ordinance. <br /> Section 84: Subsection 4.020.A. 175 of Ordinance 1671-89, which <br /> reads: <br /> "Undevelopable Area" means: <br /> a. Wetlands and their buffers; <br /> b. Slopes which are determined by supporting studies to be <br /> unsuitable for development, and their buffers; <br /> c. Unstable soils <br /> d. Streams and their buffers; <br /> is hereby amended to read: <br /> "Undevelopable Area" means: <br /> a. Regulated wetlands; <br /> b. Geologically hazardous areas which are determined by <br /> supporting studies to be unsuitable for development; <br /> c. Streams; <br /> d. Habitats of primary association; <br /> e. Plant associations of infrequent occurrence. <br /> Section 85: Subsection 4.020.A.181 of Ordinance 1671-89, which <br /> reads: <br /> "Wetlands" means lands transitional between terrestrial and <br /> aquatic systems where the water table is usually at or near the <br /> surface or the land is covered by shallow water. Wetlands must <br /> have one or more of the following three attributes: <br /> a. At least periodically, the soil supports hydrophytes; <br /> b. The substrate is predominantly undrained hydric soil; <br /> c. The substrate is non-soil and saturated with water at some <br /> time during the growing season of each year. <br /> 46 <br />
