4 <br /> .4. <br /> Section 88: Section 44 .D of ''Ordinance 1671-89, as amended by <br /> Ordinance 1765-91, 1812-91 and 1832-91, which reads: <br /> Section 37 of this ordinance, Environmentally Sensitive Areas, is <br /> interim and shall remain in effect until March 1, 1992. <br /> is hereby repealed. <br /> Section 89: The text of Section 37 of Ordinance 1671-89, as amended <br /> by Ordinance 1729-90 is hereby repealed. <br /> Section 90: Savings Clause. Nothing contained in this Ordinance <br /> shall be construed as abating any action now pending under or by <br /> virtue of any ordinance of the City herein superseded; or as <br /> discontinuing, abating, modifying or altering any penalty accrued or <br /> to accrue, or as affecting the liability of any person, firm or <br /> corporation, or as waiving any right of the City under any ordinance <br /> or provision thereof in force at the time of passage of this <br /> Ordinance. <br /> Section 91: Sections 1 through 24 of this ordinance shall be <br /> codified in Title 19 of the Everett Municipal Code. <br /> Section 92: Severability. If any section, subsection, clause, <br /> phrase or any portion of this ordinance is for any reason held to be <br /> invalid or unconstitutional by the decision of any court of <br /> competent jurisdiction, such decision shall not affect the validity <br /> of the remaining portions of this ordinance.
