E.Public Utility and Infrastructure Exception. If the application of <br /> this Section would prohibit a development proposal by a <br /> public agency or public utility to construct utility lines <br /> for the conveyance of water, sewage, storm drainage, natural <br /> gas, or telecommunications; or the construction of collector <br /> or arterial streets and highways, the agency or utility may <br /> request an exception pursuant to this Subsection. Such a <br /> request shall be reviewed by the Hearing Examiner using <br /> Review Process III .B. The Hearing Examiner may approve, or <br /> approve with modifications such a request only when the <br /> following findings are made: <br /> 1. There is no other practicable alternative to the <br /> proposed development with less impact on the <br /> environmentally sensitive area; and <br /> 2. The proposal mitigates the impacts on the <br /> environmentally sensitive areas to the maximum extent <br /> possible; and <br /> 3 . The proposal does not impact a significant fish or <br /> wildlife habitat area. <br /> F. Prohibition on Variances; Other Exceptions Which Are Permitted <br /> by This Ordinance. The variance procedures described in Section <br /> 19. 41 .130 of the Everett Municipal Code shall not apply to the <br /> standards of this Ordinance. The following Sections permit <br /> alteration or modification of the requirements of this Ordinance <br /> for protection of environmentally sensitive areas: <br /> 1 . Section 8 for modification of standards for geologically <br /> hazardous areas. <br /> 2 . Section 10 and 11 for modification of standards for wetlands <br /> and their required buffers. <br /> 3 . Section 14 for modification of standards for streams and <br /> their required buffers. <br /> Section 6: Permitted Uses. Uses permitted on lots containing or <br /> adjoining environmentally sensitive areas shall be the same as those <br /> permitted in the use zone in which the lot is located. Each use <br /> shall be evaluated in accordance with the review process required <br /> for the proposed use in the use zone in conjunction with the <br /> requirements of this Ordinance, and other City, State, and Federal <br /> regulations. <br /> Section 7: Submittal Requirements - Supporting Information. <br /> A. Submittal Requirements. Applications for land uses or <br /> developments proposed on lots with environmentally sensitive <br /> areas shall be filed with the Planning Department. The City may <br /> waive specific submittal requirements determined to be <br /> unnecessary for review of a specific application. All <br /> developments proposed on lots which may contain or adjoin <br /> environmentally sensitive areas shall be evaluated by the <br /> applicant to provide the information necessary for the Planning <br />
