` - 1 ORDINANCE 'NO. ACV - An Ordinance amending Section 1 of Ordinance No. 1812-91 , and Section 44(D) of Ordinance No. 1671-89 , Extending the Effective Date of Section 37 of Zoning Code Ordinance No. 1671-89 (Environmentally Sensitive Areas) , and Declaring an Emergency to Exist. WHEREAS, the City of Everett adopted Ordinance No. 1812-91 which extended Section 37 of Zoning Ordinance No. 1671-89 (Environmentally Sensitive Areas) until December 1 , 1991; and WHEREAS, the City Council is still reviewing the Planning Commission recommendation to amend the Environmentally Sensitive Areas section of the Zoning Code, and will not be adopting said revisions prior to the expiration of the interim regulations on December 1 , 1991, and WHEREAS, the City Council finds that it is necessary to further extend the interim regulations until such time as the Council adopts revised regulations; and WHEREAS, the City Council finds that an emergency situation will exist if the interim Environmentally Sensitive Areas section of the Zoning Code expires prior to the adoption of the revised regulations. NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: SECTION 1: Section 44(D) of Ordinance 1671-89, as amended by Section 1 of Ordinance No. 1765-91, which reads: Section 37 of this ordinance, Environmentally Sensitive Areas, is interim and shall remain in effect until September 1 , 1991 . is hereby amended to read: Section 37 of Ordinance No. 1671-89, as amended by Ordinance No. 1729-90 and Ordinance No. 1812-91 , is interim and shall remain in effect until March 1, 1992 . SECTION 2 : This is a public emergency ordinance necessary for the protection of the public health, safety and welfare; and shall be made effective immediately upon becoming valid.
