EVERETT <br /> ORDINANCE NO. 1826-91 <br /> AN ORDINANCE relating to failure of sex offenders to <br /> register as required by state law, adding a new <br /> section to Ordinance No. 1145-85 (EMC Title 10 - <br /> Everett Criminal Code) . <br /> NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> SECTION 1 : A new section is hereby added to Ordinance No. 1145- <br /> 85 (EMC Title 10 - Everett Criminal Code) , to read as follows: <br /> Failure to Register - Sex Offenders <br /> A person who knowingly fails to register as required by <br /> RCW 9A. 44 . 130, as now or hereafter amended, is guilty <br /> of a class C felony if the crime for which the <br /> individual was convicted was a class A felony or a <br /> federal or out-of-state conviction for an offense that <br /> under the laws of this state would be a class A felony. <br /> If the crime was other than a class A felony under the <br /> laws of this state or a federal or out-of-state <br /> conviction for an offense that under the laws of this <br /> state would be a class A felony, violation of the <br /> provisions of RCW 9A. 44 . 130, as now or hereafter <br /> amended, is a gross misdemeanor. <br /> SECTION 2 : Codification. <br /> Section 1 of this ordinance will be codified as a new section of <br /> EMC Chapter 10. 24 . <br /> SECTION 3 : Severability. <br /> Should any section, subsection, paragraph, sentence, clause or <br /> phrase of this ordinance or its application to any person or <br /> situation be declared unconstitutional or invalid for any reason, <br /> such decision shall not affect the validity of the remaining <br /> portions of this ordinance or its application to any other person <br /> or situation. The City Council of the City of Everett hereby <br /> declares that it would have adopted this ordinance and each <br /> section, subsection, sentence, clause, phrase or portion thereof <br /> irrespective of the fact that any one or more sections, <br />
