EVERETT ORDINANCE NO. 1826-91 AN ORDINANCE relating to failure of sex offenders to register as required by state law, adding a new section to Ordinance No. 1145-85 (EMC Title 10 - Everett Criminal Code) . NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: SECTION 1 : A new section is hereby added to Ordinance No. 1145- 85 (EMC Title 10 - Everett Criminal Code) , to read as follows: Failure to Register - Sex Offenders A person who knowingly fails to register as required by RCW 9A. 44 . 130, as now or hereafter amended, is guilty of a class C felony if the crime for which the individual was convicted was a class A felony or a federal or out-of-state conviction for an offense that under the laws of this state would be a class A felony. If the crime was other than a class A felony under the laws of this state or a federal or out-of-state conviction for an offense that under the laws of this state would be a class A felony, violation of the provisions of RCW 9A. 44 . 130, as now or hereafter amended, is a gross misdemeanor. SECTION 2 : Codification. Section 1 of this ordinance will be codified as a new section of EMC Chapter 10. 24 . SECTION 3 : Severability. Should any section, subsection, paragraph, sentence, clause or phrase of this ordinance or its application to any person or situation be declared unconstitutional or invalid for any reason, such decision shall not affect the validity of the remaining portions of this ordinance or its application to any other person or situation. The City Council of the City of Everett hereby declares that it would have adopted this ordinance and each section, subsection, sentence, clause, phrase or portion thereof irrespective of the fact that any one or more sections,
