On January 14, 2009, the public hearing was continued to February 4, 2009. On <br /> February 4, 2009, the public hearing was postponed pending further notice. On March 18, 2010, notice was provided <br /> that the public hearing would occur on at 6:30 P.M. on April 14, 2010. On April 8, 2010, Petitioner requested the <br /> public hearing be postponed until further notice. On May 16, 2011, notice was provided and the public hearing held <br /> on June 15, 2011. <br /> Based upon the June 15, 2011,public hearing,the attached Ordinance provides for the vacation to be granted subject to <br /> the petitioner meeting the following conditions: 1)conveyance of a new alley right of way connecting to Pacific Ave; <br /> 2) payment for an independent appraisal; and 3)compensation to the City an amount equivalent of the full appraised <br /> value of 600 square feet for the right of way area being vacated. <br /> RECOMMENDATION(Exact action requested of Council): Adopt the attached Ordinance vacating that portion of <br /> the east/west alley abutting Lot 11, Replat of Block 718, Plat of Everett, subject to the conditions as set forth in the <br /> Ordinance. <br /> 1 <br />
