The state law authorizes certain collective gardens for <br /> medical cannabis, but allows cities to regulate these collective gardens. The law also contains ambiguities <br /> that could be misinterpreted and result in the establishment of large cannabis grow operations. In an effort to <br /> comply with state law, while studying what regulation of collective gardens is necessary, the City needs to <br /> enact emergency interim regulations to prevent the widespread proliferation of unregulated collective <br /> gardens throughout the City. The interim regulations restrict collective gardens authorized by state law to <br /> certain zones within the City and establish baseline regulations which are clearly necessary. Based upon the <br /> City's work plan, the interim regulations will be in effect for one year following adoption so that City staff <br /> may have a sufficient opportunity to further study collective gardens and detennine their proper regulation <br /> within the City. <br /> RECOMMENDATION (Exact action requested of Council): Approve the Emergency Ordinance relating to <br /> medical cannabis, establishing interim zoning regulations, and declaring an emergency to exist. <br /> 16 <br />
