In an <br /> effort to comply with state law, while studying what regulation of collective gardens is necessary, the City <br /> enacted emergency interim regulations to prevent the widespread proliferation of unregulated collective <br /> gardens throughout the City. However, such interim regulations cannot, due to inadequate study, sufficiently <br /> address the concerns relating to the location and regulation of collective gardens. Through the Everett Police <br /> Department's experience raiding numerous grow operations, the City has identified particular concerns <br /> relating to the storage and handling of common chemical compounds, exhaust and air quality, storage of <br /> cannabis, regulation of electrical wiring, and public safety and crime prevention. Because additional time is <br /> necessary to adequately study possible regulations addressing these and other concerns, it is necessary for the <br /> City to enact an emergency one year moratorium upon the acceptance of applications for collective gardens, <br /> as authorized under interim regulations. As a result of this moratorium, no collective gardens will be <br /> authorized within the City until the moratorium expires. <br /> RECOMMENDATION (Exact action requested of Council): Approve the Emergency Ordinance relating to <br /> medical cannabis, declaring an emergency to exist, and declaring a moratorium upon the acceptance of <br /> applications. <br /> 17 <br />
