EVERETT 1T 'OC I 'CIL 1.GENDA I` COVER SHEET
3
PROJECT TITLE:
An Ordinance relating to Briefing COUNCIL BILL# (( (eg el
Harassment,Amending Proposed Action Originating Department Legal
Ordinance No. 1521-88, as Consent Contact Person Laura Van Slyck
amended(EMC 10.23.010) Action Phone Number 425-257-8738
8/10/11 First Reading FOR AGENDA OF 8/10/11, 8/17/11,
8/17/11 Second Reading 8/24/11
8/24/11 Third Reading
Public Hearing
Budget Advisory Initialed by:
Department Head
CAA
Council President 3474.
Location Preceding Action Attachments Department(s) Approval
Amount Budgeted -0- Account Number:
Expenditure Required -0- Account Number:
Budget Remaining -0-
Additional Required -0-
DETAILED SUMMARY STATEMENT:
The 2011 State legislature amended state law to define additional conduct as constituting felony Harassment.
The current version of the City of Everett Harassment law defines conduct constituting both gross
misdemeanor and felony Harassment. The best practice for the City of Everett is to define conduct
constituting gross misdemeanor Harassment, over which the City has jurisdiction, but not set forth a detailed
description of what constitutes felony Harassment, which is prosecuted by the State. The revisions that
would take effect with this ordinance would change the City criminal code to simply refer to the appropriate
state law code section for a detailed description of what constitutes felony Harassment.
RECOMMENDATION (Exact action requested of Council):
Adopt an Ordinance relating to Harassment, Ordinance No. 1521-88, as amended(EMC 10.23.010).
19
