4 <br /> • - ., . •.• the <br /> maximum fine amount and term of imprisonment set forth in EMC 10.04.080.A. <br /> C. For purposes of this section, "nonfelony injuries"means that the accident resulted only in <br /> minor bruises, cuts, scrapes or similar injuries to the bicyclist or pedestrian. <br /> D. For purposes of this section, "bicyclist" means any person operating or riding upon a <br /> bicycle. <br /> E. The duties setforth in subsection A of this section shall not apply to any person injured <br /> or incapacitated by such accident to the extent of being physically incapable of <br /> complying therewith. <br /> F. If none of the persons who would otherwise be entitled to receive the information <br /> required by subsection A of this section are in condition to receive the information, and <br /> no police officer is present, the operator of any vehicle involved in such accident, after <br /> fulfilling all other requirements of subsection A of this section insofar as possible on his <br /> or her part to be performed, shall forthwith report such accident to the nearest office of <br /> the Everett police depaitiuent and submit thereto the information specified in subsection <br /> A of this section. <br /> Section 6: <br /> Section 5 of Ordinance No. 1228-86, as amended by Section 4 of Ordinance No. 2393-99 (EMC <br /> 6.08.050), which reads as follows: <br /> Penalties. <br /> Unless otherwise provided,any person,firm or corporation violating any of the provisions of this <br /> chapter is guilty of a gross misdemeanor and may be punished by a fine of not more than five <br /> thousand dollars or imprisonment of not more than one year in jail, or by both such fine and <br /> imprisonment. <br /> Is hereby amended to read as follows: <br /> Penalties. <br /> Unless otherwise provided, any person, firm or corporation violating any of the provisions of this <br /> chapter is guilty of a gross misdemeanor and may be punished by a fine of not more than five <br /> and/or imprisonment : -- •• • . . - •.• , : ' : °:,: . • •-- ..- <br /> imprisonment up to maximum fine amount .and.term of imprisonment set forth in EMC <br /> 10.04.080.A. <br /> Section 7: <br /> Section 16 of Ordinance No. 3135-09(EMC 12.02.133),which reads as follows: <br /> Failure to stop for law enforcement officer. <br /> Any operator of a vessel who willfully fails to stop when requested or signaled to do so by a <br /> person reasonably identifiable as a law enforcement officer is guilty of a gross misdemeanor,. <br /> punishable by up to one year in jail and by a fine of not more than five thousand dollars. <br /> 6 <br /> 33 <br />
