The third project has been delayed by protracted negotiations with ExxonMobil and American Distributing on an agreement to reimburse the City for incremental costs associated with handling contaminated soil and groundwater from the historical operations of those companies along Federal and vacated Everett Avenues. The City has requested an extension to the SRF Loan Agreement for this reason. Amendment No. 3 provides for a one-year extension. RECOMMENDATION: Authorize the Mayor to sign Amendment No. 3 to the Washington State Revolving Fund Loan with Washington State Department of Ecology for the Bond Street Combined Sewer Overflow Control Facilities. 135
