9 <br /> ADDENDUM <br /> WASHINGTON STATE <br /> • INVESTMENT COST RECOVERY INCENTIVE <br /> FOR RENEWABLE ENERGY <br /> This INVESTMENT COST RECOVERY INCENTIVE ADDENDUM is agreed upon in view of the fact that <br /> the Customer may qualify for an investment cost recovery incentive for renewable energy resources under the <br /> provisions of RCW Sections 82.16.110 through 82.16.130, which provide incentives for the production of cer- <br /> tain forms of renewable energy, commonly referred to as the production incentive. <br /> The Parties hereby agree as follows: <br /> I. TERM <br /> This Agreement shall run from the date first set forth above until the earlier of: (1)the date upon which electric <br /> generator for which incentives may be available is permanently disconnected from Snohomish County PUD's <br /> ("PUD") electric system; or, (2) June 30, 2020; provided that all obligations incurred before the termination of <br /> the contract shall continue in force until fully satisfied. <br /> II. CERTIFICATION REQUIREMENTS <br /> The PUD shall pay to Customer the Investment Cost Recovery Incentive ("ICRI") authorized by the above refe- <br /> renced statutes,provided that Customer meets all the following requirements: <br /> 1. Customer has received a certification from the Washington State Department of Revenue and the <br /> Washington Rural Energy Development Center, as required by RCW 82.16.120(2), that its Genera- <br /> tor qualifies for 1CR1; <br /> 2. Customer has, by August 1 of each year during the Term of this Agreement, filed an application with <br /> the PUD meeting all requirements of RCW 82.16.120(3)(a); <br /> 3. The PUD has notified Customer pursuant to RCW 82.116.120(3)(b) that the ICRI payment is autho- <br /> rized; <br /> 4. The amount of ICRI requested by Customer does not exceed the amount that the PUD has been au- <br /> thorized to pay under RCW 82.16.120(4); <br /> 5. The Customer has complied with the record-keeping requirements of RCW 82.16.120(3)(c), <br /> 6. Customer has complied with all other requirements contained in RCW 82.16.120. <br /> III. PAYMENT <br /> A. Amount of Payment. If all the conditions specified in Section II of the Agreement are met, the PUD <br /> shall pay to the Customer an ICRI for power generated between July 1 and June 30, inclusive (the "fis- <br /> cal year"), in the amount of fifteen cents per economic development kilowatt-hour, as defined in RCW <br /> 82.16.120(4), multiplied by the applicable factors (if any) specified in RCW 82.16.120(4), provided that <br /> the total ICRI payments to Customer shall not exceed $5,000 in any fiscal year. <br /> Snohomish County PUD Net Metering Agreement Rev.4/2011 15 <br /> Reviewed: ALS 6-27-11 7 5 <br />
