Sheet 41st Street I/C Vicinity <br /> State Route Control Section Region I-5, SR 526 to US 2 HOV Lanes <br /> I-5 3105 NWR <br /> State Project— Snohomish County <br /> This Agreement is between the STATE OF WASHINGTON, Department of Transportation, <br /> hereinafter the "STATE," and CITY OF EVERETT, hereinafter the "LOCAL AGENCY," <br /> collectively hereinafter the"PARTIES." <br /> WHEREAS, the PARTIES entered into Turnback Agreement TB 1-0211 on 10/22/2008, to <br /> convey right of way and Roadway Facilities to the LOCAL AGENCY upon completion of the <br /> STATE's construction and improvement to a section of Interstate 5 located in the vicinity of <br /> 41st Street/I-5 Interchange, and <br /> 'WHEREAS, it is deemed desirable to supplement TB 1-0211 to include existing drainage <br /> easements associated with the Road Way Facilities, and <br /> NOW, THEREFORE, in consideration of the tun's, conditions, covenants, and performance <br /> contained herein, or attached and incorporated and made part of hereof. <br /> IT IS MUTUALLY AGREED AS FOLLOWS: <br /> 1. Section 1.2,is revised to include easements to be conveyed to the LOCAL AGENCY, as <br /> follows: <br /> 1.2 The LOCAL AGENCY agrees to accept ownership of the right of way and Roadway <br /> Facilities as shaded, where applicable, on Exhibit :"A-1", as follows: <br /> Blue (light) Indicates Roadway Facilities and right of way to be conveyed in fee to <br /> the LOCAL AGENCY <br /> PaggE1 of 2 <br />
