In 1998 the site was short platted and subsequently a single-family residence (4414 Federal Avenue)was constructed on that portion of the property where the City's easement existed. The current owners of the residence, Wayne and Vicki Witsoe, sought to construct an addition to the residence near the City's easement. An investigation of the as-built location of the 36-inch water pipeline and a property survey by the Witsoes showed that the water pipeline was constructed outside of the City's easement area. The Witsoes and City have agreed to correct the legal description of the easement area to coincide with the as-built location of the water pipeline. As compensation for the easement correction,reimbursement in the amount of$3,640.00 is being provided to the Witsoes for their survey and design costs. RECOMMENDATION: Authorize the Mayor to sign the Easement Correction Agreement with Witsoe for waterline at 4414 Federal Avenue. 89
