"Easement"means that certain EASEMENT dated November 20, 1961, between <br /> Parkland Lutheran Children's Home,Inc., a corporation of the State of Washington as <br /> Grantor and the City of Everett, a municipal corporation, filed for record under <br /> Snohomish County Auditor's Recording No. 1518277, for the purpose of constructing, <br /> reconstructing, maintaining and operating a water pipeline and necessary appurtenances. <br /> E. Witsoe is the successor in interest to Parkland Lutheran Children's Home,Inc.'s interest <br /> in the Witsoe Property. <br /> BACKGROUND <br /> The City and Witsoe each desire to correct the Easement legal description affecting the <br /> Witsoe Property to reflect the as-built location of the City's water pipeline facilities. <br /> • <br /> CORRECTION AGREEMENT <br /> For good and valuable consideration and the terms of this agreement,the City and Witsoe <br /> hereby agree that the following description of the Easement which reads: <br /> EASEMENT DESCRIPTION OVER TRACT A <br /> A strip of land 20 feet in width beginning at the southeast corner of the above-described <br /> property,thence north a distance of 365.9 feet along the east property line of said tract to <br /> the true point of beginning; thence north 45 degrees west a distance of 140.20 feet more or <br /> less to the northerly property line of said tract,being also the southerly line of Federal <br /> Street; thence east a distance of 28.28 feet; thence south 45 degrees east a distance of 100.21 <br /> feet more or less to the east line of said tract; thence south a distance of 28.28 feet to the true <br /> point of beginning, <br /> 2 <br /> 91 <br />
