6 <br /> Draft(August 29,2011) <br /> Attachment B <br /> Reasonable Incremental Costs <br /> The cost categories listed below are,as described in Section 6 of the Reimbursement Agreement, <br /> Reasonable Incremental Costs that have been or are expected to be incurred by the City in constructing <br /> the Project that are attributable to the presence of petroleum contaminants in soil or groundwater from <br /> historical operations of ExxonMobil Oil Corporation(ExxonMobil)or American Distributing Company <br /> (ADC). These costs are for work associated with additional engineering,management,documentation, <br /> and contractor expenses. The additional tasks and services expected for this project include(at a <br /> minimum)the items listed below,separated into two categories by entity: <br /> City's Consultants <br /> a) Technical review of existing conditions,work plans,data reports,and site information regarding <br /> the Exxon-Mobil ADC site. Such costs incurred prior to May 21,2011,will be reimbursed as past <br /> costs under section 8 of the Reimbursement Agreement and such costs incurred on or after May <br /> 21,2011 will be reimbursed as Reasonable Incremental Costs under section 5. <br /> b) Consulting to the City related to contamination during engineering,bid documents preparation, <br /> and construction. Consulting prior to construction will be reimbursed as past costs under <br /> Section 8 of the Reimbursement Agreement. Costs for consulting during construction is a <br /> Reasonable Incremental Cost under Section 6 of the Reimbursement Agreement only if <br /> necessary to assess unanticipated conditions(e.g.,contamination other than petroleum),for <br /> periodic project site visits,necessary consulting for treatment and disposal of petroleum- <br /> impacted water,or if a dispute arises between the City,ExxonMobil,and American Distributing <br /> Company. <br /> Construction Contractor Costs <br /> The bid items of the construction contract have been established to allocate the base construction costs <br /> of a sewer utility project to the City and to allocate the incremental construction costs related to known <br /> contamination to Exxon Mobil/ADC. The table below summarizes the bid items related to <br /> contamination. The actual cost of each of these bid items will be established by the final construction <br /> costs for each bid item. <br /> a) Industrial Hygienist Prepared Health and Safety Plan(HASP). The Reasonable Incremental Cost <br /> associated with this item is the cost to upgrade a HASP to include provisions relating directly to <br /> petroleum-impacted soil and:groundwater. <br /> b) Hazardous Waste Operations and Emergency Response(HAZWOPER)Training. <br /> c) Incremental Groundwater Dewatering and Treatment Costs Related to Contamination. The <br /> Reasonable Incremental Cost associated with this item is the necessary,incremental cost to <br /> treat and dispose petroleum-impacted water. <br /> d) Soil Hauling from Station 13+80 to 20+82 to Republic Services'3td and Lander Transfer Station in <br /> Seattle. The Reasonable Incremental Cost associated with this item is the rate established in the <br /> construction contract between the City and its contractor for hauling of petroleum-impacted soil <br /> subject to a credit of$14.13 per ton. <br /> • <br /> 57 <br />
