a 1. AMENDMENT NO.2 TO PROFESSIONAL SERVICES AGREEMENT BETWEEN THE CITY OF EVERETT AND PERTEET,INC. The City and Perteet Inc. agree to amend and modify their professional services agreement dated September 16, 2009 (the"Agreement") as follows: WHEREAS, Perteet Inc. and the City entered into an Agreement dated September 16, 2009 to provide engineering services for the General Engineering and Consulting(GEC)Management, Rucker&Hoyt Avenue Streetscape Improvements, and NOW THEREFORE, the City of Everett and Perteet Inc. agree to amend and modify the Agreement as follows: • 1., Paragraph 4.c "Compensation" shall remain the same with the changes as noted below on Tasks Five and Eight: C. Total compensation,including all services of the Contractor and its subcontractors, subconsultants, and agents and their expenses, shall not exceed a maximum of One Million, Three Hundred Six Thousand Dollars ($1,306,000). The rates for such services are attached as Exhibit A.
