Provided, however, the participating Agencies have no duty or obligation to <br /> inspect or confiscate ORCA Cards and nothing in this Agreement shall be construed as <br /> creating any such duty or obligation. If an ORCA UW Card is confiscated by a <br /> Participating Agency, it shall be sent promptly to the University's Designated <br /> Representative along with any available supporting information regarding the reasons <br /> for, and date of, the confiscation. <br /> 12.0 CARD GROUP MOVEMENT VIA WHITELIST <br /> The Lead Agency agrees to move Card Groups selected by the Institutions on and off the <br /> ORCA Whitelist. As the University transitions to ORCA UW Cards, the Lead Agency will move <br /> Seattle, Bothell, Tacoma and Harborview Card Groups on or off the Whitelist per the request(s) <br /> of the University. The Institutions will provide their request(s) no later than two weeks prior to <br /> the Card Group move commencement. The Institutions or Lead Agency will notify the other <br /> about any errors in this process as soon as they are determined. The Parties understand and <br /> agree that the ORCA system does not allow for instantaneous implementation of a card move <br /> between groups, Card Block, Product Block or removal of cards from the ORCA Whitelist. The <br /> Parties agree to meet and discuss the potential need for adjustments, if any, to trip counts to <br /> address lags in the implementation or Card Groups from the ORCAroups,Whitelist.rd Blocks or Product <br /> Blocks, or removal of card <br /> 13.0 ORCA BUSINESS ACCOUNT WEBSITE <br /> 13.1 The ORCA Business Account Website is the primary means by which the Institutions <br /> shall purchase and manage the U-PASS Product. The Institutions will use the ORCA <br /> Business Account Website to obtain information about the use of ORCA Cards. The <br /> Institutions agree that they will use the ORCA Business Account Website when it is <br /> available and that each access and use of said website shall be subject to the ORCA <br /> Terms of Use and Privacy Statement that are in effect and posted on the ORCA <br /> Business Account Website at the time of such access and use, except where the ORCA <br /> Terms of Use and Privacy Statement conflict with this Agreement, in which case this <br /> Agreement shall prevail. The Participating Agencies will notify the Institutions of any <br /> changes to the ORCA Terms of Use and Privacy Statement no later than ten (10) days <br /> prior to implementation. <br /> 13.2 The Participating Agencies shall be responsible for making the ORCA Business Account <br /> Website functions available for use by the Institutions on a reasonably regular and <br /> consistent basis; provided, however, the Institutions understand and agree that <br /> uninterrupted access to and use of the ORCA Business Account Website functions are <br /> not guaranteed, and agree that they will contact the Designated Representative at the <br /> Lead Agency by email or telephone if the website functions are not available. The Lead <br /> Institution and Participating Agencies agree to meet and discuss the potential need for <br /> adjustments, if any, to trip counts to address lags in the implementation of card moves <br /> between groups, Card Blocks or Product Blocks, or removal of cards or Card Groups <br /> from the ORCA Whitelist, if the ORCA Business Account Website functions required to <br /> implement said Blocks, card moves or card removals are not available for an extended <br /> period of time and the blocking and unblocking of products cannot occur. <br /> 13.3 The Institutions understand and agree that they are responsible for complying with any <br /> reasonable security standards regarding the ORCA Business Account Website as <br /> specified in Attachment 3. <br /> U-PASS Agreement <br /> 5 9 Page 14 of 44 Final, October 2011 <br />
