12 <br /> CONTRACT TERMS AND CONDITIONS <br /> DRINKING WATER STATE REVOLVING FUND <br /> NEW TRADITIONAL <br /> (MUNICIPAL) <br /> Part 1. SPECIAL TERMS AND CONDITIONS <br /> • <br /> PREAMBLE <br /> 1.1. Definitions <br /> As used throughout this Drinking Water State Revolving Fund Loan Contract, the following terms shall <br /> have the meaning set forth below: <br /> A. "Contract"shall mean this Drinking Water State Revolving Fund Loan. <br /> B. "Contractor" shall mean the Local Government identified on the Contract Face Sheet performing <br /> service(s) under this Contract and who is a Party to the Contract, and shall include all employees <br /> and agents of the Contractor. <br /> C. "The Board" shall mean the Washington State Public Works Board created in Revised Code of <br /> Washington (RCW)43.155.030, and who is a Party to the Contract. <br /> • <br /> D. "Department of Health" shall mean the Washington State Department of Health, Office of <br /> Drinking Water,who is the recipient of the Drinking Water State Revolving Fund grant and <br /> regulates drinking water systems in the State of Washington. <br /> 1.2. Authority <br /> Acting under the authority of RCW 70.119A.170 and RCW 43.155.040, the Board has awarded the <br /> Contractor a Drinking Water State Revolving Fund loan for an approved project. The Contractor will be a <br /> sub-recipient of funds provided by the United States Environmental Protection Agency, CFDA Number <br /> 66.468, Title: Safe Drinking Water State Revolving Fund, award year: 2011. <br /> 1.3. Purpose <br /> The Board and the.Contractor have entered into this Contract to undertake a local project that furthers the <br /> goals and objectives of the Drinking Water State Revolving Fund Loan Program. The project will be <br /> undertaken by the Contractor and will include the activities.described in Attachment I: Scope of Work. <br /> The project must be undertaken_in accordance with the following Program Special Terms and Conditions <br /> and all applicable federal, state and local laws and ordinances, including but not limited to those <br /> specifically enumerated in Attachment III. • <br /> . <br /> 1.4. Order of Precedence. <br /> In the event of an inconsistency in this Contract, the inconsistency shall be resolved by giving precedence <br /> in the following order: - <br /> A. Applicable federal and State of Washington statutes and regulations. <br /> B. Special Terms and Conditions including attachments. <br /> C.
