12 <br /> .ti,Un <br /> AMENDMENT NO.2 TO PROFESSIONAL SERVICES AGREEMENT BETWEEN <br /> THE CITY OF EVERETT <br /> AND <br /> JOHN BOZEAT&ASSOCIATES LLC <br /> The City and John Bozeat&Associates LLC,hereinafter referred to as the"Service Provider," <br /> agree to amend and modify their professional services agreement dated 27 January 2009 (the <br /> "Agreement")as follows: <br /> WHEREAS,the Service Provider and the City entered into an Agreement to provide consulting <br /> services related to valves and actuators located at the Water Filtration Plant;and <br /> WHEREAS work is not yet completed on the Project and the City and Service Provider require <br /> additional time to complete the Plant valve service-life evaluation; and <br /> WHEREAS,the City and the Service Provider agree to amend their Agreement to extend the <br /> time of completion from January 31,2012,to January 31,2014; and <br /> NOW THEREFORE,the City of Everett and John Bozeat&Associates LLC agree to amend and <br /> modify the previously amended Agreement as follows: <br /> 1. Paragraph 3 is modified to read as follows: <br /> 3.Time of Beginning and Completion of Performance: This Agreement shall <br /> commence on the date of execution of the Agreement and shall be completed by <br /> January 31,2014. <br /> 2. The effective date of this Amendment is January 31,2012. <br /> 3.
