INTERLOCAL AGREEMENT REGARDING LEGAL SERVICES <br /> THIS INTERLOCAL AGREEMENT ("Agreement") is entered into between the <br /> Cities of Burlington, Everett, Mount Vernon, and any other local government entity <br /> that might join this Coalition of Cities(collectively, the "Coalition"). <br /> RECITALS <br /> 1. The members of the Coalition are public agencies as defined by Ch. 39.34 <br /> of the Revised Code of Washington, and may enter into interlocal agreements on the <br /> basis of mutual advantage to provide services and facilities in the manner and <br /> pursuant to forms of governmental organization that will accord best with geographic, <br /> economic, population, and other factors influencing the needs and development of <br /> local communities. <br /> 2. The lawsuit brought by the National Wildlife Federation against the Federal <br /> Emergency Management Agency("FEMA") of the Department of Homeland Security <br /> (United States District Court for the Western District of Washington Cause No. 2:11- <br /> cv-02044-RSM) seeks relief, in part, in the form of an injunction issued by the Court <br /> that would prevent FEMA from (1) providing flood insurance, either directly or through <br /> third-party private entities, for any new development project situated within the 100 <br /> year floodplain of a community identified in the attached Exhibit"A," and (2) prevent <br /> FEMA from processing any changes to its flood insurance rate maps which identifies <br /> areas of Special Flood Hazard, regardless of whether any such changes would <br /> increase the accuracy of the flood insurance rate maps. <br /> 3. The potential adverse impact of the relief sought by the National Wildlife <br /> Federation on members of the Coalition and property owners is so significant and far- <br /> reaching, members of the Coalition are joining together to explore all legal and other <br /> avenues available to avoid or minimize such impacts. Members of the Coalition wish <br /> to retain outside counsel (Counsel)to represent the Coalition in the lawsuit and in <br /> related legal challenges, and wish to collectively pay Counsel as further set forth <br /> below. <br /> NOW THEREFORE, in consideration of the terms and provisions contained <br /> herein, the members of the Coalition agree as follows: <br /> AGREEMENT <br /> 1. Purpose: It is the purpose of this Agreement to have the Coalition <br /> collectively pay for the Legal Services of legal counsel to represent the Coalition's <br /> interests in any legal proceedings related to United States District Court for the <br /> NPDES INTERLOCAL AGREEMENT <br /> Page 1 of 9 <br />
