I <br /> Council President <br /> Location Preceding Action Attachments Department(s)Approval <br /> Amount Budgeted $0 Account Number: <br /> Expenditure Required $0 Account Number: <br /> Budget Remaining -0- <br /> Additional Required -0- <br /> DETAILED SUMMARY STATEMENT: <br /> In some cases a court-monitored deferral of a gross misdemeanor or misdemeanor crime may be an <br /> appropriate alternative to punishment for persons who will benefit from a treatment program if the treatment <br /> program is provided under circumstances that do not unreasonably endanger public safety and the traditional <br /> goals of the criminal justice system. In cases that would benefit from this alternative, following agreement <br /> of the parties, the Court assigns the matter to the Court Probation Department. If the conditions of the <br /> deferral are satisfied after the agreed-upon time period, the charge is either reduced or dismissed. If the <br /> conditions of the deferral are not satisfied, the Court reviews the factual record, which is entered into <br /> evidence without objection from the Defendant,and enters judgment on the original charge. <br /> RECOMMENDATION(Exact action requested of Council): <br /> Adopt an Ordinance relating to Court-Monitored Deferrals,adding a new Chapter to the Everett Criminal <br /> Code(Title 10 of the Everett Municipal Code). <br /> 1 <br />
