7 <br /> 2. Vegetation on the property exceeds the maximum 12 inch height allowed by City <br /> ordinance and is a violation of EMC 8.20.020(E) and a public nuisance. The <br /> Respondent violated said City ordinance. <br /> 3. Two vehicles with expired license tabs parked on the property in public view are <br /> violations of EMC 8.22.030(A) and public nuisances. The Respondent violated said <br /> City ordinance. <br /> 4. Vehicles parked between a residential structure and right of way on a non-approved <br /> surface is a violation of EMC 19.34.080(A). The Respondent violated said City <br /> ordinance. <br /> 5. The residential and accessory structures on the property are neglected, unsecure <br /> and abandoned and are an attractive nuisance to children because they create a <br /> temptation for children to explore and play in the buildings or structures to their <br /> danger. The residential structure is a harbor for vagrants and/or criminals. This <br /> condition renders the residential structure as dangerous as defined by IPMC <br /> 108.1.5(7) and is in violation of IPMC 106.1. The Respondent violated said City <br /> ordinance. <br /> ORDER <br /> Based on the Findings of Fact and Conclusions of Law as stated above, it is hereby <br /> determined that the Respondent is in default and was in violation of IPMC 106.1, EMC <br /> 8.20.020(A)(C)(E)(G), EMC 8.22.030 and EMC 19.34.080(A) and are hereby ordered to: <br /> 1. The Respondent must abate all violations of IPMC 505.1, IPMC 604.1, IPMC 106.1, <br /> EMC 8.20.020(A)(C)(E)(G), EMC 8.22.030 and EMC 19.34.080(A) on property <br /> located at 5401 S. 4th Avenue, Everett, Washington. <br /> 2. All abatement of the violations on said property must be completed by December <br /> 23, 2016. The cleanup and abatement shall include: <br /> a. The Respondent Estate shall remove or properly store all discarded items visible <br /> on the property. <br /> b. The Respondent Estate shall maintain the property free of nuisances including <br /> discarded garbage, junk and household items. Approved garbage containers <br /> with tight fitting lids shall be used to store garbage and refuse on the property. <br /> c. The Respondent Estate shall cut and properly dispose of all overgrown, dead <br /> and noxious vegetation from the yards of the property. <br /> d. The Respondent Estate shall maintain all structures on the property in a clean, <br /> safe, secure and sanitary condition. <br /> e. The Respondent Estate shall board the property to secure from trespass. <br />
