&elPimAl-- <br /> /FE <br /> 7111 <br /> RESOLUTION NO. <br /> A RESOLUTION authorizing recovery of abatement costs <br /> pursuant to EMC 1.20.090 at 522 94th Street SW, Everett, Washington. <br /> WHEREAS,the Everett Municipal Code (the "EMC") Section 1.20.090 authorizes the <br /> City to abate code violations and recover the abatement costs; and <br /> WHEREAS, on October 30, 2016, City of Everett Police Officers responded to 522 94th <br /> Street SW ("the Property") and found an abandoned residential and garage structures that were <br /> open to trespass with overgrown vegetation in the yards; and <br /> WHEREAS, the parcel number of the Property is 00726800000900, and abbreviated legal <br /> description: <br /> ROYAL GARDENS DIV. NO. 1 BLK 000 D-00 - LOT 9 <br /> WHEREAS, on November 2, 2016, an Order of the City of Everett Code Official was <br /> sent to the property owner Estate of Edward J. Totty ("the Owner") requiring securing of the <br /> residential structure and garage from trespass, and explaining that failure to do so would result in <br /> the City abating the violations on the Property; and <br /> WHEREAS,the International Property Maintenance Code authorizes the code official to <br /> order a vacant and abandoned structure that is a harbor for vagrants and/or criminals to be <br /> properly secured from entry, and may cause property to be secured at the owner's cost, if the <br /> owner fails to do so within a specified time; and <br /> WHEREAS,the City, through a contractor, secured the residential structure and garage <br /> from trespass on November 4, 2016 <br /> WHEREAS, on January 19, 2017, the City of Everett Violations Hearing Examiner issued <br /> an Order against the Owner requiring, among other things, the removal of the overgrown <br /> vegetation from the yards of the property, and the Examiner imposed a$1000 penalty against the <br /> Owner; and <br /> WHEREAS the Owner failed to abate the violations, including the removal of <br /> overgrown vegetation from the yards of the property by the date set by the Order. <br /> WHEREAS,the City, through a contractor, conducted the abatement of overgrown <br /> vegetation from the yards of the property on February 17, 2017; <br /> 1 <br />
