4 <br /> For the purpose of this code, any structure or premises that have any or all of the <br /> conditions or defects described below shall be considered dangerous: <br /> (7) The building or structure is neglected, damaged, dilapidated, unsecured or <br /> abandoned so as to become an attractive nuisance to children who might play <br /> in the building or structure to their danger, becomes a harbor for vagrants, <br /> criminals or immoral persons, or enables persons to resort to the building or <br /> structure for committing a nuisance or an unlawful act. <br /> 3. EMC 8.20.020 (E) Nuisances, which reads: <br /> Except as authorized by subsection H of this section or as may be allowed by <br /> another city ordinance, no person owning, leasing, renting, occupying or having <br /> charge or possession of any property in the city, including vacant lots, shall maintain <br /> or allow to be maintained on the property outside of a fully enclosed structure such <br /> as a shed, dwelling, or closeable garage, any of the following conditions visible from <br /> any street, alley, or other public or private property: <br /> (E) Dead, decayed, diseased, noxious or hazardous trees, or vegetation or any <br /> vegetation (not including vegetation located in flower beds) taller than forty-two <br /> inches high or grass taller than twelve inches in height; <br /> Conclusions of Law Based on Above Findings: <br /> 1. The residential structure on the property has been neglected and abandoned and <br /> has become an attractive nuisance to children because it creates a temptation for <br /> children to explore and play in the buildings or structures to their danger. The <br /> residential structure is a harbor for vagrants and/or criminals. This condition <br /> renders the residential structure as dangerous as defined by IPMC 108.1.5(7) and is <br /> in violation of IPMC 106.1. The Respondent violated said City ordinance. <br /> 2. Overgrown, dead and noxious blackberry vines and vegetation on the property that <br /> exceeds the maximum 12 inch height is a violation of EMC 8.20.020(E) and a public <br /> nuisance. The Respondent violated said City ordinance. <br /> ORDER <br /> Based on the Findings of Fact and Conclusions of Law as stated above, it is hereby <br /> determined that the Respondent Este is in default and was in violation of IPMC 106.1 <br /> and EMC 8.20.020 (E) and is hereby ordered to: <br /> 1. The Respondent Estate must abate all violations of IPMC 106.1 and EMC 8.20.020 <br /> (E) on property located at 522 — 94th Street SW, Everett, Washington. <br /> 2. All abatement of the violations on said property must be completed by January 27, <br /> 2017. The cleanup and abatement shall include: <br />
