condemnation proceeding with respect to the Improvements or any <br /> part thereof without the written consent of the City. <br /> ARTICLE XIII: DESTRUCTION OF LEASED PREMISES <br /> In the event the Leased Premises are damaged or destroyed by <br /> fire or other casualty following the Payment Obligation <br /> Commencement Date, this Lease shall not terminate nor shall there <br /> be any abatement of the Lease Payments otherwise payable by City <br /> hereunder and City may repair, rebuild or restore all or any <br /> portion of the Improvements that have been damaged or destroyed in <br /> full compliance with all legal requirements and to the same condi- <br /> tion, character and at least equal value and utility to that <br /> existing prior to such damage or destruction. <br /> ARTICLE XIV: ACCESS BY LESSOR <br /> At any time during the term hereof Lessor or Lessor's agents <br /> shall have the right to enter the Leased Premises on reasonable <br /> notice to examine the same. Nothing contained herein shall be <br /> construed to impose upon Lessor any duty of repair of the Leased <br /> Premises. <br /> ARTICLE XV: SURRENDER OF PREMISES <br /> The City shall promptly yield and deliver to Lessor possession <br /> of the Leased Premises at the termination of this Lease at the <br /> expiration date or at any prior termination date, unless the Leased <br /> Premises are purchased by the City in accordance with the terms <br /> hereof. <br /> ARTICLE XVI: OWNERSHIP OF IMPROVEMENTS <br /> All Improvements now or hereafter located on the Leased <br /> Premises are and shall be the property of Lessor during, and only <br /> during, the continuance of the term of this Lease and no longer. <br /> Except as is provided in Article XIX, at all times during the term <br /> of this Lease, the Improvements and the leasehold interest of <br /> Lessor under this Lease shall not be conveyed, transferred or <br /> assigned and at all such times the holder of the leasehold interest <br /> of Lessor under this Lease shall be the owner of the Improvements. <br /> Except as is provided in Article XIX, any attempted conveyance, <br /> transfer or assignment, whether voluntarily or by operation of law <br /> or otherwise, to any person, corporation or other entity shall be <br /> void and of no effect whatsoever. Upon any termination or and <br /> expiration of this Lease, whether by reason of the normal expira- <br /> tion of the term hereof, or otherwise, all of Lessor's right, title <br /> and interest therein shall cease and terminate and title to the <br /> Improvements shall automatically vest in the City and the Improve- <br /> ments shall be surrendered by Lessor to the City.
