• <br /> to comply with the provision of this ordinance shall be and same <br /> is hereby declared to be a public nuisance. <br /> The City is hereby authorized to apply to any court of competent <br /> jurisdiction for and such court, upon hearing and for cause <br /> shown, may grant a preliminary, temporary or permanent injunction <br /> restraining any person, firm, and/or corporation from violating <br /> any of the provisions of this ordinance and compelling compliance <br /> with the provisions thereof and the violator shall pay all City <br /> costs of seeking such injunction in the event the City is <br /> successful in obtaining the injunction. <br /> SECTION 15: REPEALER. <br /> Ordinance No. 's 680-80, 1626-89 Section 6 of Ordinance No. 1228- <br /> 86 and all ordinances in conflict herewith are hereby repealed. <br /> SECTION 16: THIRD PARTY LIABILITY. <br /> It is expressly the purpose of this ordinance to provide for and <br /> promote the health, safety and welfare of the general public and <br /> not to create or otherwise establish or designate any particular <br /> class or group of persons who will or should be especially <br /> protected or benefited by the terms of this ordinance. <br /> It is the specific intent of this ordinance to place the <br /> obligation of complying with its requirements upon the owner and <br /> possessors of animals and no provisions nor any term used in this <br /> ordinance is intended to impose any duty whatsoever upon the City <br /> or any of its officers or employees, for whom the implementation <br /> and enforcement of this ordinance shall be discretionary and not <br /> mandatory. <br /> Nothing contained in this ordinance is intended nor shall be <br /> construed to create or form the basis of any liability on the <br /> part of the City, or its officers, employees or agents, for any <br /> injury or damage resulting from the failure to comply with the <br /> provisions of this ordinance, or by reason or in consequence of <br /> any inspection, notice, order, certificate, permission or <br /> approval authorized or issued or done in connection with the <br /> implementation or enforcement of this ordinance, or by reason of <br /> any action or inaction on the part of the City related in any <br /> manner to the enforcement of this ordinance by its officers, <br /> employees or agents. <br /> 21 <br />
