The Manager shall investigate any complaint concerning <br /> licensed facilities and, upon determining that a license should <br /> be revoked, he/she shall provide written notice to the licensee <br /> of such determination by certified mail or personal service. The <br /> Licensee may appeal the revocation by filing a written appeal <br /> within ten (10) days of notification to the Manager, Everett <br /> Animal Shelter, 2930 36th Street, Everett, WA 98201. Hearing <br /> upon such duly requested appeal shall be conducted before the <br /> Animal Control Advisory Board within thirty (30) days of such <br /> request, with notice to the appellant by certified mail or <br /> personal service, no later than ten (10) days prior to the <br /> hearing; failure to file a timely request shall terminate any <br /> appeal right, and the Manager's decision revoking the license <br /> shall not be reviewable otherwise. <br /> F. Any person whose license is revoked shall, within ten <br /> (10) days thereafter or within the time set by the Animal Control <br /> Advisory Board, humanely dispose of all animals in excess of pre- <br /> facility licensing numbers owned, kept, or harbored by such <br /> person and no part of the license fee shall be refunded. <br /> G. If a license application is denied or revoked, an <br /> applicant may reapply after one year has elapsed from the date of <br /> the appeal hearing, or from the date of compliance with the order <br /> to remove animals from denied/revoked facility, whichever is <br /> latest. <br /> SECTION 7 : PROHIBITED CONDUCT. <br /> A. Offenses relating to safety and sanitation. It shall <br /> be unlawful for any person to: <br /> 1. Allow the accumulation of animal feces in any open <br /> area, run, cage or yard wherein animals are kept <br /> and to fail to remove or dispose of feces at least <br /> once every twenty-four (24) hours; <br /> 2 . Fail to remove the fecal matter deposited by <br /> his/her animal on public or private property of <br /> another before the owner and or animal, leaves the <br /> immediate area where the fecal matter was <br /> deposited; <br /> 3 . Fail to have in his/her possession the equipment <br /> necessary to remove his/her animal's fecal matter <br /> 8 <br />
